TERMS AND CONDITIONS – SCOOTER & MOTORCYCLE RENTAL

2. Purpose

These Terms and Conditions govern the rental of scooters and motorcycles offered on the website www.rentabikesamui.com to clients (hereinafter the “Client”).
Any reservation constitutes full and unconditional acceptance of these Terms.

3. Booking & Payment

Online booking: via the website or in person.

Deposit: 30% upon booking; balance due on vehicle delivery.

Accepted payment methods: international credit card, cash (THB), bank transfer, or other methods as indicated.

Booking confirmation is effective only after receipt of the deposit.

4. Rental Conditions

  • Minimum age: 18 years.
  • License: Valid international or Thai motorcycle driver’s license.
  • Security deposit: Depends on vehicle type.
  • The Client agrees to return the vehicle in its original condition, with a full fuel tank.

5. Insurance & Liability

  • Vehicles are insured in accordance with Thai regulations.
  • The Client remains responsible for any damage.
  • All traffic fines (speeding, parking, etc.) are the Client’s responsibility.

6. Cancellation & Refund

  • Cancellation ≥7 days before rental: deposit refunded (minus possible banking fees).
  • Cancellation <7 days or no-show: deposit is non-refundable.
  • In case of severe weather or force majeure, the company reserves the right to cancel and fully refund.

7. Vehicle Use

The Client agrees to:

  • Comply with the Thai traffic code.
  • Not lend the vehicle to an undeclared third party.
  • Not carry dangerous or illegal goods.
  • Not leave Koh Samui.
  • Not remove the GPS tracker.
  • Immediately notify the rental company in case of an accident.

8. Maintenance & Breakdowns

In case of breakdown, the Client must immediately contact the company.
No repairs may be carried out without prior authorization.

9. Personal Data

Information collected is used solely for booking management and customer follow-up, in compliance with the Thai Personal Data Protection Act (PDPA 2019).

10. Governing Law & Disputes

These Terms are governed by Thai law.
Any dispute shall fall under the exclusive jurisdiction of the courts of Koh Samui.

2. วัตถุประสงค์

ข้อกำหนดนี้ใช้บังคับสำหรับการเช่าสกู๊ตเตอร์และมอเตอร์ไซค์ที่ให้บริการบนเว็บไซต์ www.rentabikesamui.com
การจองใด ๆ ถือเป็นการยอมรับข้อกำหนดนี้อย่างเต็มที่

3. การจองและการชำระเงิน

การจองออนไลน์: ผ่านเว็บไซต์หรือที่ร้าน
มัดจำ: 30% ชำระเมื่อทำการจอง ยอดคงเหลือชำระเมื่อรับรถ
วิธีการชำระเงินที่รับ: บัตรเครดิตสากล เงินสด (THB) โอนเงิน หรือวิธีอื่นตามที่แจ้ง
การยืนยันการจองจะมีผลก็ต่อเมื่อได้รับมัดจำแล้วเท่านั้น

4. เงื่อนไขการเช่า

  • อายุขั้นต่ำ: 18 ปี
  • ใบขับขี่: ใบขับขี่สากลหรือใบขับขี่มอเตอร์ไซค์ที่ถูกต้อง
  • เงินประกัน: ขึ้นอยู่กับประเภทรถ
  • ผู้เช่าต้องคืนรถในสภาพเดิมพร้อมน้ำมันเต็มถัง

5. ประกันและความรับผิดชอบ

  • รถทุกคันมีประกันตามกฎหมายไทย
  • ผู้เช่ารับผิดชอบต่อความเสียหายทั้งหมด
  • ค่าปรับจราจรทุกประเภทเป็นความรับผิดชอบของผู้เช่า

6. การยกเลิกและการคืนเงิน

  • ยกเลิก ≥7 วันก่อนเช่า: คืนมัดจำ (หักค่าธรรมเนียมธนาคารหากมี)
  • ยกเลิก <7 วันหรือไม่มารับรถ: มัดจำไม่คืน
  • หากมีเหตุสุดวิสัยหรือสภาพอากาศไม่เอื้ออำนวย บริษัทขอสงวนสิทธิ์ในการยกเลิกและคืนเงินเต็มจำนวน

7. การใช้รถ

ผู้เช่าตกลงว่า:

  • ปฏิบัติตามกฎหมายจราจรไทย
  • ไม่ให้บุคคลอื่นที่ไม่ได้แจ้งไว้ยืมรถ
  • ไม่ขนส่งสินค้าอันตรายหรือผิดกฎหมาย
  • ห้ามนำรถออกนอกเกาะสมุย
  • ห้ามถอดอุปกรณ์ติดตาม (GPS tracker)
  • แจ้งบริษัททันทีหากเกิดอุบัติเหตุ

8. การบำรุงรักษาและการเสียหาย

หากรถเสีย ผู้เช่าต้องติดต่อบริษัททันที
ห้ามซ่อมเองโดยไม่ได้รับอนุญาต

9. ข้อมูลส่วนบุคคล

ข้อมูลที่เก็บรวบรวมใช้เพื่อการจัดการการจองและการให้บริการลูกค้าเท่านั้น
เป็นไปตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล (PDPA 2019)

10. กฎหมายและข้อพิพาท

ข้อกำหนดนี้อยู่ภายใต้กฎหมายไทย
ข้อพิพาทใด ๆ อยู่ภายใต้เขตอำนาจศาลเกาะสมุย

2. Objet

Les présentes CGV régissent la location de scooters et motos proposée sur le site www.rentabikesamui.com aux clients (ci-après le « Client »).
Toute réservation implique l’acceptation pleine et entière des présentes.

3. Réservation & Paiement

Réservation en ligne : via le site ou sur place.
Acompte : 30 % à la réservation, solde à la remise du véhicule.
Modes de paiement acceptés : carte bancaire internationale, espèces (THB), transfert bancaire ou autres selon le site.
La confirmation de réservation n’est effective qu’après réception de l’acompte.

4. Conditions de location

  • Âge minimum : 18 ans révolus
  • Permis : Permis de conduire international ou permis moto valide
  • Dépôt de garantie : dépend du véhicule
  • Le Client s’engage à restituer le véhicule dans l’état d’origine, plein de carburant

5. Assurance & Responsabilités

  • Les véhicules sont assurés selon la réglementation thaïlandaise
  • Le Client reste responsable des dommages
  • Les amendes (excès de vitesse, stationnement, etc.) sont à la charge du Client

6. Annulation & Remboursement

  • Annulation ≥7J avant : remboursement de l’acompte (moins frais bancaires éventuels)
  • Annulation <7J ou non-présentation : acompte non remboursé
  • En cas d’intempéries ou de force majeure, l’entreprise se réserve le droit d’annuler et de rembourser intégralement

7. Utilisation du véhicule

Le Client s’engage à :

  • Respecter le code de la route thaïlandais
  • Ne pas prêter le véhicule à un tiers non déclaré
  • Ne pas transporter de marchandises dangereuses ou illégales
  • Ne pas quitter Koh Samui
  • Ne pas enlever le tracker GPS
  • Prévenir immédiatement le loueur en cas d’accident

8. Entretien & Pannes

En cas de panne, le Client doit contacter immédiatement l’entreprise.
Aucune réparation ne doit être effectuée sans accord préalable.

9. Données personnelles

Les informations collectées sont utilisées uniquement pour la gestion des réservations et le suivi clientèle, conformément à la loi thaïlandaise sur la protection des données (PDPA 2019).

10. Droit applicable & Litiges

Les présentes CGV sont régies par la loi thaïlandaise.
Tout litige sera soumis à la compétence exclusive des tribunaux de Koh Samui.
